Rapidly evolving AI assistants are creating headaches for data processors

The rapid evolution and widespread adoption of digital AI assistants such as Microsoft Copilot and Anthropic Claude are creating significant compliance challenges for data controllers in Denmark. Recent figures from Statistics Denmark show that 59 percent of companies now use artificial intelligence, a sharp increase from 15 percent in 2023.

This growth has dramatically increased the workload for compliance professionals. Because tech giants continuously update their products and add new features at a rapid pace, existing risk and impact assessments quickly become outdated. For example, Microsoft introduced flex routing in the spring, which allowed European data to be routed outside the EU during peak periods, creating potential compliance risks.

Experts highlight that these AI tools present unique challenges regarding data storage, confidentiality, and understanding when suppliers are permitted to use data to train models. The Danish Data Protection Agency emphasizes that organizations must update their impact assessments whenever the circumstances of their IT services change, meaning companies that purchase constantly evolving products must understand the implications of those changes.
